These End User Terms of Services sets out the terms of use on which you may make use of the PostCo Services (as defined below). Please read these End User Terms of Service carefully before you start to use the PostCo Services. By registering to access PostCo services, you indicate that you have read, understood and accept these End User Terms of Service, together with out privacy policy and that you agree to abide by them. We encourage you to read these End User Terms of Service, and contact us if you have any particular questions in relation to the PostCo Services. If you do not agree to these End User Terms of Service use, you must refrain from using the PostCo Services. In these End User Terms of Service "you" includes anyone acting on your behalf or with your express or implied authority.

Our Contract With You

1.1 These are the Terms, which, together with the Privacy Policy, are the basis on which we supply the Service to you following your registration on the PostCo Website. By registering on the PostCo Website, you agree to be bound by these Terms.

Registration Process

2.1 You must register on the PostCo Website, prior to making a Delivery Request.

2.2 In order to complete the online registration process, you must provide us with the following information, which must be accurate:

  1. Your full name;
  2. A Valid Malaysian Billing Address;
  3. An operational mobile telephone number and monitored email address.

This information will be held by us in accordance with our Privacy Policy.

2.3 If your registrations is successful, we will provide you with a PostCo Username. This will appear on the screen immediately after the registration has completed and will also be sent to you by email.

2.4 Once you have been given a PostCo Username you may Book A Spot at any of our collection points, the procedure in respect of which is set out in Clause 4 below.

2.5 If the information you have provided us with in registration is false, fraudulent or incorrect you will not be able and/or entitled to use the Service. We reserve the right to suspend your registration to our discretion and/or until such time as you provide us with your correct details via our contact form.

2.6 If the information you have provided us with on registration subsequently changes (for example, if you move house or get a new email address), you are required us immediately using our contact form and when doing so, you are required to notify us of your full name and provide your PostCo Username).

2.7 By providing us with your Customer Account details you authorize us to take payment from you in accordance with these Terms. If we accidentally debit your account by more than we should, we will refund you the excess amount within 14 working days beginning after the day the mistake has been drawn to our attention.

Pricing

3.1 You will be charged 2.90 per parcel or RM6.90 for 3 parcels (inclusive of GST) delivered to any of our Collection Points. You will not be charged for your first Delivery Request.

3.2 The Customer Account will be linked to your Bank Account. You undertake to authorize us to deduct amounts payable to PostCo for the services done as stipulated.

3.3 If we are unable to process a card payment from you for any reason, we will contact you and we will arrange payment by another means.

3.4 We reserve the right in our absolute discretion to vary the PostCo Collection Point Service Price and/or the Subscription Price upon 30 days' notice to all our account holders via the email address you have provided us upon registration.

Request for Delivery

4.1 When making a Delivery Request you undertake:

  1. To ensure the delivery of any goods do not, by all means, contain or comprise of Prohibited Articles as defined in Clause 8.1 below;
  2. To Book a Spot prior to addressing the parcel delivery. Upon confirmation of booking, proceed to enter the address of your desired Collection Point as the delivery recipient address on your parcel.
  3. To ensure there are no arrangements for the delivery of any goods that incur either excess and/or duty charges payable on delivery; and
  4. To not provide instructions to leave parcel outside the Collection Point or with a third party (e.g. neighbour) in the case where delivery cannot be made to the Collection Point (for example, because delivery is attempted outside of the Collection Point's working hours) as this will disrupt the Collection Point’s ability to retrieve your parcel. If such arrangements have been made, PostCo and the Collection Point will not be liable for any loss or damage incurred to the parcel.

4.2 When the Parcel containing your Articles is delivered to the Collection Point we will send you an email (a Delivery Confirmation Notice) via the email address you have provided us upon registration, informing you that your Parcel has been delivered and provide you with a parcel reference number (Parcel Reference Number).

4.3 Upon receiving the Delivery Confirmation Notice you must collect your Parcel from the specified Collect Point within 14 days.

Collection of Parcel

5.1 When collecting your Parcel you must provide the PostCo Agent at the Collection Point with:

  1. Your PostCo User’s Unique Collection Code; AND/OR
  2. A proof of identity of the account holder (namely a valid passport, identification card (IC), driving license or student card)

If you are unable to provide either of these requirements, the PostCo Agent may refuse to give you your Parcel unless and until you can fulfill the requirements. In such circumstances, the PostCo Agent will continue to hold your Parcel at the Collection Point until the expiry of the period set out in the Delivery Confirmation Notice.

5.2 If someone else is collecting a Parcel on your behalf as your Nominee, they will need to provide the PostCo Agent at the Collection Point with:

  1. Your PostCo User’s Unique Collection Code; AND/OR
  2. Proof of identity of the account holder (namely a valid passport, identification card (IC), driving licence or student card)

If your Nominee is unable to provide either of these requirements, the PostCo Agent may refuse to give them your Parcel unless and until they can fulfill the requirements. In such circumstances, the PostCo Agent will continue to hold your Parcel at the Collection Point until the expiry of the period set out in the Delivery Confirmation Notice.

5.3 When you collect your Parcel, you will be sent a Collection Confirmation Notice by email confirming that your Parcel has been collected.

5.4 If you fail to collect the Parcel within the period set out in the Delivery Confirmation Notice we reserve the right in our absolute discretion at any time after 14 days following delivery either to:

  1. Return the Parcel to the sender at your cost (and such cost – which shall include the cost of returning the Parcel plus a reasonable administration fee – will be taken from your Customer Account prior to return); OR
  2. Store the Parcel else where other than at the Collection Point.

5.5 If we return your Parcel in accordance with Clause 4.7(a) above we will notify you by email.


6

Supply Of Service

6.1 We shall supply the Service to you using reasonable care and skill.

6.2 We have absolute discretion as to the means and procedure to be followed in the handling and storage of Parcels delivered to Collection Points.

6.3 We reserve the right to reject delivery of a Parcel at a Collect Point if:

  1. You are not a registered Customer;
  2. Your name and/or PostCo Username are not clearly identifiable on the Parcel; AND/OR
  3. The Package:
    1. Exceeds the weight or dimensions specified in Clause 7.2 below;
    2. Is not Correctly Packaged;
    3. Does not have a Label attached;
    4. Appears to and/or contains Prohibited Articles; OR
    5. Appears to be damaged.

6.4 If we reject delivery of a Parcel we will:

  1. Notify you by email that we have refused delivery of your Parcel and explain why; AND
  2. Not charge you for your booking.
  3. Note that if you have not registered and send a parcel to one the Collection Points, it will be rejected and you will not receive a notification by email.

Parcel Criteria

7.1 All Parcels must be Correctly Packaged and labed to the address of the Collection Point.

7.2 Parcels must not weigh more than 20 kilograms nor exceed dimensions of 50 centimetre x 50 centimetre x 50 centimetre.

Prohibited Articles

8.1 Prohibited Articles include but are not limited to:

  1. Any objects or substance that are either illegal in the jurisdiction or in respect of which carriage or possession is illegal in the Jurisdiction.
  2. Gases, pyrotechnics, arms and ammunition or corrosive, toxic, flammable, explosive, oxidizing or radioactive materials or any other noxious, dangerous or hazardous goods or goods likely to cause damage.
  3. Money, prescribed drugs, liquids, foodstuff, perishable goods, coins, or plants or plant seeds or derivatives.
  4. Any item of high value including without limitation jewellery, bullion, deeds, bonds, securities, stamps, antiques, fine art.
  5. Birds, fish, animals or any other creatures.
  6. Any item that requires specialist storage or storage at a specific temperature.

8.2 If you nevertheless (whether knowingly or unknowingly) place a Delivery Request which results in a Prohibited Article being delivered to a Collection Point, we shall be under no liability whatsoever in connection with the Prohibited Article however arising and you shall be liable for any and all loss or damage caused by, or in connection with the Prohibited Article however arising and shall indemnify us against all penalties, claims, damages, costs and expenses whatsoever arising in connection therewith and the Prohibited Article may be destroyed or otherwise dealt with in our absolute discretion by us or by any other person in whose custody they may be at the relevant time.

8.3 We shall be entitled, in our absolute discretion to suspend or cancel your registration if you arrange for Prohibited Articles to be delivered to one of our Collection Points.


9

Our Liability

9.1 All Parcels delivered to Collection Points are held there at the Customer's risk. We do not accept liability for any loss or damage caused to Parcels whilst they are being held at Collection Points.

9.2 Notwithstanding Clause 8.1 above, in the event that you are able to supply us with (i) valid proof of delivery to the Collection Point; and (ii) confirmation of the value of the Articles contained in the Parcel, we may in our absolute discretion elect to compensate you up to a maximum of RM200.00 per Parcel. In order to be eligible to receive such compensation, you must provide us with the above information in writing via email to [email protected] within 30 days of the date on which you say the Parcel was delivered. If we decide to provide you with compensation, this will be paid directly into your Customer Account.

9.3 We do not exclude or restrict in any way our liability for death or personal injury resulting from our own negligence or the negligence of our employees or agents acting in the course of their employment or agency or for fraud or fraudulent misrepresentation.

9.4 We shall not be liable whether in contract, tort, under statute or otherwise (including in each case negligence) for any of the following type of losses or damages arising under or in relation to provision of the Service:

  1. Special, indirect or consequential loss or damage whatsoever; OR
  2. Any loss of profits, business contracts, anticipated savings, goodwill or revenue (whether direct or indirect).

9.5 Notwithstanding Clause 9.3 for which our liability is unlimited, our entire liability whether arising from our breach of contract, negligence, or breach of statutory duty in connection with our supply of the Service to you shall be limited to the value of the Parcel contents or RM200.00, whichever is lower.

9.6 If delivery of your Parcel is attempted outside of the Collection Point's working hours and is left outside a Collection Point or with a third party, we shall not accept liability for the Parcel contents.

9.7 The Company is not liable as a bailee in respect of any Parcels delivered to Collect Points.

Events Outside Our Control

10.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

10.2 An Event Outside Our Control means any act or event beyond our reasonable control including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, street rallies, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks which prevents us from supplying the Service to you.

10.3 If an Event Outside Our Control takes place:

  1. We will notify you as soon as reasonably possible by email; AND
  2. Our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Events Outside Our Control. Where the Event outside Our Control affects our performance of the service to you, we will restart the service as soon as reasonably possible after the Event Outside Our Control is over.

Variations

11.1 No variation, extension or cancellation of these Terms shall be binding upon the Company unless and until it is confirmed in writing under the hand of a Director of the Company and, for the avoidance of doubt, it is declared that no person other than such Director has authority to negotiate or enter into any commitment on behalf of the Company the effect of which would or might (but for this present clause) involve the Company in any legal liability whatsoever. Any future versions of these Terms appearing on the Company Website are deemed confirmed in writing under the hand of a Director of the Company.

11.2 We may amend or repeal these Terms at any time by giving you 10 days' notification, such notification to be posted on the Company Website and your attention drawn to it by email. Your continued use of the Service will constitute acceptance of the revised Terms

Applicable Law

12.1 These Terms shall be construed in accordance with the laws of the Federal Constitution of Malaysia.

12.2 The Courts of Malaysia shall have exclusive jurisdiction in relation to any matters arising out of a contract incorporating these Terms.


13

Third Parties

11.1 A person who is not a party to these Terms shall have no right to enforce any of these terms.


14

Waiver

14.1 We do not give up our rights by delaying or failing to exercise them at any time.


15

Severance

15.1 If any of these Terms are found by a court to be illegal or not enforceable, all other Terms will still be in effect.


16

Definitions

16.1 "Article" means any article which is not a Prohibited Article and "Articles" shall be construed accordingly.

16.2 "PostCo Agent" means one of a number of locations listed on the Company Website.

16.3 "Collection Point" means a PostCo Agent’s location listed on the Company Website.

16.4 "Company" or "we" or "us" or "our" or "ourselves" means between Postal Connection Sdn. Bhd., a company duly incorporated in accordance with the Companies Act 1965 and the Regulations thereof and having its registered business address at 2-37, PV 128,128, Jalan Genting Klang, 53300 Kuala Lumpur., and includes the Company's servants, agents, and any person or persons receiving, storing or carrying Parcels under the contract with the Company (including but not limited to PostCo Agents).

16.5 “Company Website" means www.postco.com.my.

Our Contract With You

These are the Terms, which, together with the Privacy Policy, are the basis on which we supply the Service to you following your registration on the PostCo Website. By registering on the PostCo Website, you agree to be bound by these Terms.

1.1 If you are entering into these Terms of Service on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms of Service, in which case the Terms of Service “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with these Terms of Service, you shall not accept the Terms of Service on behalf of such entity and you are not authorized to use this Website or the Services.

1.2 By registering for the Services, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Services’ registration form. Our collection and processing of registration data and certain other information about you are governed by our Privacy Policy.

1.3 You acknowledge and agree that we may change or otherwise modify the Terms of Service in the future, such changes and modifications shall become effective immediately upon posting to the Website. You understand and agree that your continued access or use of this Website after such change or modification constitutes your acceptance of the changed or modified Terms of Service. PostCo endeavors to provide you with notice of any changes to the Terms of Service, but PostCo’s failure to do so shall not excuse your obligation to comply with any such modified Terms of Service. You agree to periodically review the most current version of these Terms of Service as posted on the Website.

1.4 You agree and acknowledge that you may be subject to additional terms applicable to certain Services provided by us that may be attached to such Services from time to time. All such terms are hereby incorporated by reference into these Terms of Service.

1.5 In the event that you commit any breach or violation of any terms and conditions under our Terms of Service, we shall be entitled to immediately terminate our Services, suspend your PostCo account, and/or may take other legal action at our disposal.

1.6 The usage of any services not provided by us directly (including, without limitation, warehousing services) requires you to enter into a separate legally binding service agreement with a third-party service provider. You acknowledge and agree that we do not assume any liability whatsoever for acts, errors, or omissions (including, without limitation, any negligence or willful misconduct) of any third-party service providers with whom you or any of your affiliates may contract, regardless of the purpose.

Description of Services

2.1 For the purpose of these Terms of Service, “Services” shall include (a) the account services of the Website, (b) all software, data, reports, text, images, sounds, video, and content made available through any of the foregoing (collectively referred to as the “Content”), and (c) Shipment services. Any new feature added to, or augmenting the Services, is also subject to these Terms of Service.

Prohibited products

3.1 The following are the types of products that, for everyone’s safety, you are prohibited to ship through PostCo:

  1. Any product related to illegal activities or which is prohibited by law in the place of origin, the destination, or any sites through which such product travel.
  2. Any product requiring specific licenses to store or distribute. Examples of products with distribution and licensing requirements may include, but are not limited to:
    1. Live plants and animals;
    2. Alcoholic beverages;
    3. Ammunition & firearms;
    4. Tobacco;
    5. Firearms and any kind of weapon;
    6. Prescription pharmaceuticals or other dangerous drugs;
    7. Explosive or hazardous products;
    8. Unique or one-of-a-kind materials; and
    9. Precious metals in the forms of bullion or reserves.

3.2 PostCo shall not be liable for any loss, damage, destruction of such prohibited product.


4

General Conditions/ Access and Use of the Services

4.1 Subject to the terms and conditions of these Terms of Service, you may access and use the Services only for lawful purposes. All rights, titles and interests in and to the Services and its components will remain with and belong exclusively to PostCo. You shall not (a) sublicense, resell, rent, lease, transfer, assign, time share or otherwise make the Services available to any third party, without written consent of PostCo; (b) use the Services in any unlawful manner (including without limitation in violation of any data, privacy or export control laws) or in any manner that interferes with or disrupts the integrity or performance of the Services or its components or otherwise violates our Terms of Service, or (c) modify, adapt or hack the Services to, or otherwise attempt to gain unauthorized access to the Services or its related systems or networks. You shall comply with any codes of conduct, policies or other notices PostCo provides you or publishes in connection with the Services, and you shall promptly notify PostCo if you learn of a security breach related to the Services.

4.2 You may not tender for shipment any of the prohibited items listed under the Clause 3.1. You grant PostCo, and any authorized third parties the right to inspect your Shipment at any time. We reserve the right to reject or suspend the carriage of any item.

4.3 You will not use the Services to (or assist another person to):

  1. a) upload any content that (i) infringes any intellectual property or other proprietary rights of any party; (ii) you do not have a right to upload under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful racially, ethnically or otherwise objectionable; or (vi) in the sole judgment of PostCo, is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose PostCo or its users to any harm or liability of any type;
  2. b) interfere with or disrupt the Services or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; or
  3. c) violate any applicable local, state, national or international law, or any regulations having the force of law;
  4. d) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; or
  5. e) obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Services.

4.4 You understand that the operation of the Services, including Your Content, may be unencrypted and involve (a) transmissions over various networks; (b) changes to conform and adapt to technical requirements of connecting networks or devices and (c) transmission to PostCo’s third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate and maintain the Services. Accordingly, you acknowledge that you bear sole responsibility for adequate security, protection and backup of Your Content. PostCo will have no liability to you for any unauthorized access or use of any of Your Content, or any corruption, deletion, destruction or loss of any of Your Content.

4.5 Subject to the Terms of Service hereof, PostCo may (but has no obligation to) provide technical support Services, through email in accordance with our standard practice. PostCo might use the consignee's personal information to send them updates about their packages, gain consignee feedback, and in general any time PostCo consider it needed to carry on its Services.

4.6 In the event that you wish to change any information regarding the Shipment, such as address, items included or other matters, you shall notify PostCo customer service at [email protected]. In the event that the Shipment has already been handled over to any shipping company, courier, or mail service (“Courier”), such changes may not become effective, or the Courier may ask a fee to validate the change.

4.7 In the event that a Shipment is not collected, the Shipment will be returned to PostCo. You may choose to collect the Shipment, at your own expenses, at a designated location provided by PostCo, or pay a return shipping fee in the amount of MYR8.00 per Shipment, and PostCo will ship it to your sender address. The Shipment will only be delivered to a local sender address. If you don’t collect the Shipment within thirty (30) days from the date the Shipment is returned to PostCo, PostCo will ship it to your sender address.

Payment

5.1 A shipping fee will be charged for each Shipment, of which shall include all costs related to the Shipment, quoted by PostCo (“Shipping Fee”). Shipping Fee shall include: shipping cost, fuel surcharge, insurance fee, import tax, import duty, remote area surcharge, courier tax handling fees, pick-up fees, and any other amount related to the activity of shipping through PostCo. You acknowledge and agree that the Shipping Fee do not include any additional fees arising out of separate agreements with third-party service providers.

5.2 Quotations for Shipping Fees by PostCo are based on the information provided by you, including but not limited to sender’s address, receiver’s address, weight, dimensions, and value of the items. In the event that there is a discrepancy between the Shipping Fees charged by PostCo and the costs for the Shipment incurred by PostCo due to incorrect information that you provided, such as incorrect weight, dimensions, value of the item(s), addresses, or any other information critical to estimate the shipping cost, you will be responsible for such discrepancy amount. PostCo specifically disclaims any liability for any Shipping Fees errors due to inaccurate or incomplete information. PostCo is not responsible for any changes or alteration of the Shipping Fees. PostCo agrees to make reasonable efforts to bill such discrepancy amount to your account in a timely manner but PostCo makes no representations or warranties regarding the amount of time needed to complete processing.

5.3 In the event that you disagree with any Shipping Fees charged to your account, you shall submit such complaint to PostCo within thirty (30) days of the fee being charged (“Dispute Period”). PostCo will not review customer requests for Shipping Fee adjustments that are received after the Dispute Period.

Our Liability

In no event shall PostCo be liable for any indirect, incidental, special or consequential damages, or damages for loss or damage of Shipments, loss of profits, revenue, data or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, the Website, any content, or any third party websites and content. In the event of an unauthorized transaction by an PostCo employee or agent ("PostCo Agent" means one of a number of locations listed on the Company Website) PostCo is only liable for the damages cap.

Notwithstanding Clause 3, on condition that PostCo is satisfied that the Customer’s claim of loss or damage to the article(s) or contents thereof is justified, the parties agree that PostCo’s liability for any loss of or damage to any article or its contents shall be limited to compensate you up to a maximum of MYR200.00 per Parcel.

Claims for loss or damage to the articles must be made no later than 14 days from the date of posting/lodgement failing which PostCo shall have no liability whatsoever. Such claims must be made in writing, accompanied by the original copy of the consignment note, supporting documents and relevant invoices or receipts, failing which the claim will be considered null and void.

All claims shall be made (a) in accordance with the claims policy and process as may be implemented and/or amended by PostCo from time to time; and (b) in writing, accompanied by the original copy of the consignment note, and all relevant supporting documents and invoices or receipts, and submitted to local customer service.

The claim coverage is null in event that:

  1. the Shipment consists of a prohibited item as set out in Section 3 herein;
  2. any information provided by you is incomplete or inaccurate;
  3. the Shipment consists of any of the following items: cash, checks, bills, tickets, coins, documents, any sort of screen (LCD, LED, etc…), televisions, food, perishable goods, plants, flowers, ceramic materials, glass materials, and/or mobile phones.

Events outside of control

7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

7.2 An Event Outside Our Control means any act or event beyond our reasonable control including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, street rallies, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks which prevents us from supplying the Service to you.

7.3 If an Event Outside Our Control takes place:

  1. We will notify you as soon as reasonably possible by email; AND
  2. Our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Events Outside Our Control. Where the Event outside Our Control affects our performance of the service to you, we will restart the service as soon as reasonably possible after the Event Outside Our Control is over.

Others

8.1 PostCo does not guarantee continuous, uninterrupted or secure access to the Services. Operation of the Services may be interfered with by numerous factors outside of our control. PostCo will make reasonable efforts to process requests for receiving or shipping merchandise in a timely manner but PostCo makes no representations or warranties regarding the amount of time needed to complete processing because our Services are dependent upon many factors outside of our control, such as delays caused by third parties. PostCo is not liable for any direct, indirect, incidental damage, loss of profit, goodwill, use, or data resulting from our inability to provide the Service. We reserve the sole right to discontinue the Website and our Services, including any of the Website’s features, at any time with or without notice to you.

8.2 You understand that PostCo does not inspect your goods nor does PostCo take any responsibility for the business decisions that you make and implement through the Services.

8.3 You are responsible to provide complete and accurate information in respect of the Shipment, including but not limited to the item category and item value of the Shipment. You shall be responsible for any error, damage, expense or consequence resulting from wrong or incomplete information provided to us. You shall further indemnify PostCo for and hold PostCo harmless from any loss or expense resulting as a consequence of the wrong information provided by you. PostCo shall not be responsible for losses or damages in the event that any item contained in the Shipment is wrongfully declared. Moreover, PostCo is in no way responsible for any damages, losses due to custom practice. PostCo shall not be liable for the accuracy and truthfulness of the information provided by you

8.4 PostCo is a technology platform that connects shippers and couriers. In no circumstances that PostCo will be liable for any Services provided by any Courier. PostCo is not liable for any damage, destruction, or loss of Shipment, late delivery, and issues with the tracking, by the Courier. PostCo is not liable for acts, errors, or omissions (including, without limitation, any negligence or willful misconduct) of any third-party service providers (including, without limitation, any delay, wrong, or missed pickup by the Courier). PostCo is not liable for the delivery time information shown on the Website. PostCo is not responsible for any delayed delivery.

8.5 PostCo is not liable for any fees, expenses, resulting as a consequence of a change of information from your side (for example recipients change of address, order cancellation, or order call-back), after a Shipment has been confirmed and paid for on PostCo. PostCo is not liable for any delay in the generation of shipping documents.

Claim Requirements

9.1 In event that a Shipment with PostCo is lost or damaged, the following claim procedures shall apply:

  1. you shall send a request for reimbursement to PostCo at [email protected], along with the tracking number of the Shipment, and any document evidencing (i) the value of the Shipment item communicated to PostCo, and (ii) the amount you paid for the Shipment item. In cases of damaged Shipments you shall provide pictures of the damaged Shipment item showing the status of the damage.
  2. the request for reimbursement must be sent within fourteen (14) days from (i) the delivery date in cases of damaged Shipments, or (ii) the date of which the tracking update of the courier returns a status of lost shipment;
  3. PostCo will take the necessary time to evaluate the case, and may ask you to provide additional documents, pictures to help clarify the case.

If the request for reimbursement is accepted, PostCo will make the refund to the User within thirty (30) days of the claim

Termination

10.1 You have the right to terminate your account at any time by sending a cancellation request to [email protected]. Subject to earlier termination as provided below, PostCo may terminate your account and these Terms of Service at any time by providing thirty (30) days prior notice to the administrative email address associated with your account. In addition to any other remedies we may have, PostCo may also terminate these Terms of Service upon thirty (30) days’ notice (or ten (10) days in the case of non-payment), if you breach any of the Terms of Service or conditions of these Terms of Service. Also, PostCo reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof).

Notices to You

11.1 You agree that PostCo may provide notice to you by posting it on our Website, emailing it to the email address listed in your account, showing a notification when you login to your account. Such notice shall be considered to be received, read and understood by you within 24 hours of the time it is posted to our Website or emailed to the email address listed in your account. If the notice is sent by mail, we will consider it to have been read and understood by you within 24 hours of the time it is delivered. PostCo reserves the right to terminate your account if you withdraw your consent to receive electronic communications.

Variations

12.1 No variation, extension or cancellation of these Terms shall be binding upon the Company unless and until it is confirmed in writing under the hand of a Director of the Company and, for the avoidance of doubt, it is declared that no person other than such Director has authority to negotiate or enter into any commitment on behalf of the Company the effect of which would or might (but for this present clause) involve the Company in any legal liability whatsoever. Any future versions of these Terms appearing on the Company Website are deemed confirmed in writing under the hand of a Director of the Company.

12.2 We may amend or repeal these Terms at any time by giving you 10 days' notification, such notification to be posted on the Company Website and your attention drawn to it by email. Your continued use of the Service will constitute acceptance of the revised Terms.

Applicable Law

13.1 These Terms shall be construed in accordance with the laws of the Federal Constitution of Malaysia.

13.2 The Courts of Malaysia shall have exclusive jurisdiction in relation to any matters arising out of a contract incorporating these Terms.

Third Parties

14.1 A person who is not a party to these Terms shall have no right to enforce any of these terms

Waiver

15.1 We do not give up our rights by delaying or failing to exercise them at any time.


16

Severance

16.1 If any of these Terms are found by a court to be illegal or not enforceable, all other Terms will still be in effect.
